By agreeing to the provisions in this policy regarding how Speediance collects, uses, and protects your relevant information, ensure that you are fully aware of and understand the meaning of all the terms in this policy and agree to accept all the terms of this policy.

The user and Speediance confirm that both parties have reached a mutual agreement on all terms of this policy based on equality and voluntary consent. If the relevant laws and regulations at the location of software use or network service provision include provisions regarding the invalidity of standard terms, you acknowledge that the terms of this policy do not fall under such circumstances of invalidity. Given that Speediance has prominently alerted you to the terms that are of significant interest to you and provided contact information for your inquiries, you should not claim or request that courts or other institutions confirm any defects in the validity of the relevant terms of this policy or assert that they do not form part of the contract, based on Speediance's failure to reasonably remind you of the standard terms in this policy or fulfill its explanatory obligations upon your request.

1. Definitions of relevant terms in this policy

1.1 In this policy, "Speediance," "速境," "速境 Speediance," or "we" refers to Shenzhen Speediance Life Technology Co., Ltd.

1.2 In this policy, "user" or "you" refers to any entity that installs, registers, logs in, uses Speediance software and/or Speediance network services, or otherwise engages with Speediance or Speediance software or network services. This does not include minors who have not reached the age of majority as defined by the laws of the software usage location or network service provision location.

1.3 In this policy, "this software" refers to the application software developed and operated by Speediance, including subsequent upgrades, patches, and updates. It can run on iOS, Android, and other operating systems.

1.4 In this policy, "this network service" refers to the services operated by Speediance through its websites or provided to users via this software and the internet.

1.5 In this policy, "minors" are defined according to the laws of the software usage location or network service provision location; "children" specifically refers to individuals under a certain age as stipulated by the laws and regulations of the software usage location or network service provision location.

1.6 In this policy, "personal data" refers to any information related to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, particularly by reference to an identifier such as a name, identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

1.7 In this policy, "processing" refers to any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation, retrieval, consultation, use, disclosure by transmission, dissemination, alignment or combination, restriction, erasure, or destruction.

1.8 In this policy, the "consent" of the data subject means any freely given, specific, informed, and unambiguous indication of the data subject's wishes by which they, by a statement or by a clear affirmative action, signify agreement to the processing of personal data relating to them.

 

2. Nature and formation of this policy

2.1 This policy constitutes a binding agreement between the user and Speediance regarding the collection, use, and protection of related privacy information. This policy is contractual in nature.

2.2 Users are requested to carefully read the "User Agreement" and accept all contents of both the "User Agreement" and this policy. If users cannot accept all contents of both the "User Agreement" and this policy, they should refuse to install, register, log in, use this software or network service, or engage in any form of contact with Speediance or its software or network services.

2.3 The user's installation, registration, login, use of this software and/or network services, or any other form of engagement with Speediance or its software or network services, will be deemed as acceptance of the entire contents of this policy and an agreement with Speediance regarding this policy.

2.4 Users should have full civil capacity. If not, you should read this policy under the supervision of a guardian and install, register, log in, use this software and/or network services, or engage in any form of contact with Speediance or its software or network services, accompanied and supervised by your guardian.

 

3. Scope of privacy information collection

3.1 Speediance will collect, store, and use the following information when providing services:

3.1.1 Personal Basic Information

(1) Personal information you provide during registration, login, or use of this software and/or network services (including but not limited to: account nickname, avatar, gender, height, weight, contact number, exercise habits, dietary habits, injuries or exercise restrictions, linked devices, exercise preferences, followers and exercise level, birth date, city of residence, etc.). This basic personal information is mainly used to establish your personal basic account and is displayed only to you in the personal information section of this software and/or network services.

(2) Data generated during the process of providing services and/or interactions with you.

(3) Data received from third parties and service providers related to you during the process of providing services and/or interactions with you.

3.1.2 Sensitive Information

To better help you achieve your fitness goals, arrange reasonable fitness plans, and improve the quality of Speediance's services, we may collect your GPS location, physiological information (including heart rate, height, weight, waist circumference, chest circumference, hip circumference, arm circumference, leg circumference, etc.), health information (including calories, body fat percentage, BMI, etc.), and exercise records.

3.1.3 Software Installation List 

We may collect information about the software installation list of the Speediance app to detect whether users have upgraded to the latest version, helping to troubleshoot issues caused by upgrades, address compatibility issues between old and new versions, and maintain system stability.

3.1.4 Web Beacons

Web beacons, also known as pixel tags or GIFs, are typically used to show whether a webpage or email has been accessed or opened, or if certain content has been viewed or clicked, for the purpose of website usage statistics and marketing activity analysis. We may use web beacons to track your site usage, collect interaction information, or information about links you click or messages you forward. To support the functions described in this policy, third parties (such as social media platforms or analytics providers, the specific third parties and the information they collect are specified in the "Third Party Information Sharing List") may place web beacons on websites or accelerate services. We will use web beacons to allow advertising networks and advertisers (specific information is specified in the "Third Party Information Acquisition List") to provide anonymous aggregated audits, research, and reports.

3.1.5 Terminal Device Information

With your authorization, Speediance has the right to collect, store, and use information related to your terminal device, including: the model of the device you use, the types and versions of software installed on the device, device settings, operating system and version information, Bluetooth and base station sensor information, location information enabled on the device, WLAN information linked to the device, etc. This information can be used by Speediance for traffic data analysis and data statistics to improve Speediance products and provide data support, thus enhancing the user experience of this software and/or network services on your device.

3.1.6 Configuration Information

(1) To uniquely identify each user's device, we may collect: the serial number and MAC address of Gym Monster or Gym Pal devices. Additionally, to detect and implement ID synchronization services, we may collect the device application list information.

(2) Configuration information of your mobile device, web browser, or other programs that access Speediance services, including device and software information, IP address, device version, device identification code, etc.

(3) Information searched and viewed in Speediance service software or programs, including search information used on the web, keywords you enter or search for, feedback, social media URLs you use, and other information and content requested or viewed during use.

(4) Identifiers and device data, such as unique device identifiers, media access control addresses, network information, hardware models, browser types, screen resolutions, corresponding ANDROID IDs, IP addresses, usage, and traffic data, and device service interaction information.

3.1.7 Mobile Application Software Information

(1) Information about the mobile applications you have used, including information about the mobile applications and devices you have used.

(2) Communication-related information using Speediance services, including communication account information, communication time, place, duration, etc.

(3) Information you share using Speediance services, including embedded data of images, videos, and other information you create and upload.

3.1.8 Cookies or Similar Information

3.1.9 Cookie information generated from your use of this software and/or network services. Cookie information is mainly used to record and save your usage traces, facilitating better login and response speeds during your use of this software and/or network services, helping you save time and effort inputting previously provided information or search descriptions. We may obtain and use your information through cookies or similar technologies and store this information as log information. This information is mainly used by Speediance to remember your identity and analyze your usage of our services to facilitate advertising optimization.

3.1.10 Logistics Information

Postal and logistics information you provide to us when ordering physical products using this software and/or network services, including recipient name, address, contact details, chosen logistics company, and logistics status. This information is mainly used by Speediance to complete the logistics and after-sales service of physical product orders.

3.1.11 Text, Photos, and Audio-Visual Information

Text, photo, and audio-visual information authorized by you during your use of this software and/or network services, including the works you create using this software and/or network services, such as the time, place, duration, content, and voice interactions of the photos and videos you take. When you choose to use this software and/or network services for recording and photographing, we have the right to access your device's camera, microphone, and recording permissions after obtaining authorization. This information is mainly used to showcase and compare your fitness results and to communicate and share with customer service, coaches, or friends.

3.1.12 Transaction Information

Payment account information provided during the use of this software and/or network services for ordering or receiving rewards, including third-party payment account information such as Alipay and WeChat. This information is mainly used for the necessary payment, refund, and cashback functions for ordering or receiving rewards through this software and/or network services.

3.1.13 Fitness Information

We may collect your fitness information, including heart rate data generated when connecting to this software, participation in classes, fitness history, Speediance rankings, exercise history, and other fitness information. If you use Apple devices, we will collect your exercise information from HealthKit. We will not use or disclose HealthKit data for advertising or other data mining purposes. The information is used to improve our services and provide more accurate data for your exercise. If you use Huawei, Xiaomi, Honor, or other brands of watches, bracelets, or mobile devices, upon your authorization, this software will automatically extract the detected data from those devices, such as real-time heart rate data. We guarantee that the information collected is only used to display real-time data to you, and we will protect the information and not share or sell it to third parties.

3.1.14 Information from Third-Party Service Platforms

When you connect this software and/or network services with other third-party platforms, we may collect information about you from those platforms. For example, you can use tools in this software to publish and share information to social media or third-party platforms. When using these tools, some account information may be transferred to us from the relevant platform account (such as account nickname, account number, avatar, etc.). For more information on what we collect from third-party platforms, please see the "Information Acquired from Third Parties List."

3.2 Users acknowledge and agree that refusing to grant the aforementioned permissions or provide relevant information may prevent you from using the corresponding functions and services of Speediance. However, this will not affect the normal provision and use of other functions and services of this software and/or network services unless otherwise stipulated by the laws of the software usage location or network service provision location. Once you revoke the corresponding authorization, Speediance will no longer collect the corresponding information. However, unless otherwise required by the laws of the software usage location or network service provision location, your revocation of authorization does not affect the information collection and storage based on your prior authorization. The information you provide to Speediance should be true and accurate. Speediance will not be liable for damages caused by false data provided by users. Speediance may use certain methods to verify the accuracy of the information provided by users when necessary.

 

4. Reasonable use of privacy information

4.1 Service Delivery We may use your personal information for:

(1)Providing, delivering, and customizing your use of Speediance services (i.e., providing feedback on your workouts);

(2)Providing you with Speediance services (including but not limited to responding to your inquiries, processing transaction information, responding to your requests, and communicating product and service details and other basic business operation matters related to support services);

(3) Enhancing or supplementing Speediance services (based on the aforementioned, providing you with products and service information you might be interested in or related updates);

(4) Facilitating the social functions of Speediance services (i.e., enabling users to add other users as friends, participate in sharing, or share content with other users);

(5) Communicating with you about Speediance services, including the status of services and responding to your inquiries, including customer support;

(6) Understanding your needs and interests, personalizing your experience, and providing support and maintenance for Speediance.

4.2 Research and Development

4.2.1 We may use your personal information for research and development improvements, including analyzing and improving Speediance services. As part of these activities, we may create aggregated, de-identified, or other anonymous data from the personal information we collect. We turn personal information into anonymous data by removing information that identifies you. We may use and share this anonymous data for lawful business purposes, including analyzing and improving Speediance services and promoting our business.

4.2.2 We will prioritize appropriate protective measures such as encryption and anonymization of your personal information based on specific usage scenarios.

4.3. Marketing

4.3.1 We and our third-party advertising partners may collect and use your personal information to provide you with complete services (such as logistics, payment, repair, etc.).

4.3.2 We may send you marketing information related to Speediance where permitted by law. You can opt-out of our marketing communications as described in the opt-out section below.

4.3.3 Targeted push or precision marketing. Our homepage - course recommendations, where the recommended content is randomly pushed by our backend, does not involve recording users' search, browsing history, usage habits, or other personal information. If changes are made, we will promptly update this policy.

4.4 Compliance and Protection

We may use your personal information for:

(1) Complying with applicable laws, lawful requests, and legal procedures, such as responding to subpoenas or requests from government authorities; Protecting our rights, privacy, safety, or property, as well as that of you or others (including by making and defending legal claims);

(2) Enforcing the terms and conditions that govern Speediance services; preventing, identifying, investigating, and stopping fraud, harmful, unauthorized, unethical, or illegal activities, including cyber-attacks and identity theft;

(3) Speediance will never use the photos you upload for facial recognition. If Speediance decides to change the purpose of the processing as described above, we will notify you of such changes and obtain your separate consent before using your personal information within the scope of the new purposes if required by applicable law.

5. Storage, sharing, transfer, and public disclosure of privacy information

5.1. Data Protection Impact Assessment

5.1.1 Before introducing any data processing activities that may pose a high risk to your privacy and freedoms, especially those involving new technologies (including but not limited to automated decision-making, user profiling, and large-scale processing of specific types of personal data), Speediance will conduct a thorough assessment.

5.1.2 Speediance's assessment will systematically describe the planned data processing operations and purposes, analyze the necessity and proportionality of the processing operations, assess the potential risks to your rights, and devise corresponding risk mitigation measures (including detailed explanations of risk response measures).

5.1.3 Speediance has engaged professionals to serve as Data Protection Officers (DPOs), responsible for overseeing and guiding our data processing activities. If you have any questions, opinions, suggestions, or feedback regarding personal information collection and processing activities, you can first provide feedback to [after-sales@speediance.com] so that Speediance can consolidate feedback to the DPO and obtain relatively comprehensive consultations.

5.1.4 If our data protection impact assessment indicates that not taking measures would pose a high risk, we will proactively consult regulatory authorities before processing. We will provide all necessary information to regulatory authorities, including the purpose and methods of processing, measures taken to safeguard the rights and freedoms of data subjects, detailed contact information for the Data Protection Officer, DPIA reports, and any other information requested by regulatory authorities. We commit to carefully consider all suggestions from regulatory authorities and take appropriate measures to protect your personal data based on the feedback.

5.2. Storage Permissions

5.2.1 With your authorization, we may encrypt and upload to the server for storage and processing your uploaded avatars, images, photos, software names, software version numbers on your device, and other information authorized by you for collection by Speediance.

5.2.2 We will properly store your personal data authorized by you within the period permitted by [the laws and regulations of the software usage location/network service provider]. At the same time, we guarantee your rights to access, correct, delete (right to be forgotten), data portability, and objection to your personal data. We will reasonably dispose of the personal data stored based on your lawful instructions and in conjunction with [the laws and regulations of the software usage location/network service provider].

5.2.3 All personal information collected by us is stored locally and does not involve the transfer of personal data to countries or regions outside the EU. If cross-border data transfer is involved in future business operations, the purpose of the transfer is limited to "providing or improving our services, meeting legal requirements, and fulfilling contractual obligations, and must be based on your explicit consent." All cross-border data transfers will be based on appropriate safeguards as provided by GDPR, such as standard contractual clauses (SCCs), binding corporate rules (BCRs), etc., and ensure that the third countries or international organizations receiving your data provide data protection at least equivalent to that of the EU.

5.2.4 If cross-border data transfer may be involved in our future business operations, we respect and protect your rights under the GDPR (including but not limited to access, correction, deletion of personal data, and objection to or withdrawal of consent for data processing), and take the following measures:

(1) Data Encryption: All data transmitted across borders will be protected by strong encryption standards to ensure the security of data during transmission.

(2) Data Access Control: Implement strict data access control policies to ensure that only authorized personnel can access your personal data.

(3) Regular Security Audits: Conduct regular security audits and risk assessments to ensure that our security measures comply with the latest industry standards and regulatory requirements.

(4) Response Plan: Develop detailed data breach response plans to respond quickly and effectively to any potential security incidents.

(5) User Notification: In the event of a data breach or other security incident, notify you and relevant regulatory authorities in a timely manner as required by GDPR.

5.3. Entrusting the Processing of Your Information

If we entrust third parties to process your personal information, we will, with your consent, enter into agreements with the trustees regarding the purpose, duration, method of processing, types of personal information, protective measures, rights, and obligations of both parties, and supervise the personal information processing activities of the trustees.

Our trustees may include:

Authorized partners for in-app services: Partners may use software development kits in the services we provide, with potential access to: your system language, network type, IP address, photo album, device information, external storage status, last known geographical location, network location information, continuous positioning, WiFi information, etc. In-app push partners access the above information to create internal user IDs, thereby helping Speediance's information push to be more precise, reducing duplicate pushes and deliveries, and avoiding information interference to you.

Authorized partners for statistical services: The statistical work of Speediance's app and website is handled by self-developed algorithms and programs, and third-party companies have not been entrusted to provide statistical services. If cooperation with third-party companies is considered in the future, Speediance will inform you and obtain your permission through announcements, messages, pop-ups, etc. Partners may use software development kits in the services we provide, with potential access to: your network type, WiFi information, IDFA, IDFV, etc. Statistical service partners access the above information to assist Speediance in analyzing the usage of product features, thereby helping to effectively improve Speediance's products and services and enhance user experience. The trustees and their information acquisition situations are subject to the "Third-party Information Acquisition List".

5.4. Sharing Your Information

5.4.1. In addition to the user's personal information actively collected by Speediance, the information publicly released by users on the Speediance platform, including text, uploaded photos, audio and video, and information uploaded during the use of social networking services, is only stored by Speediance. Under the laws and regulations related to personal information protection in the software usage location/network service provider, Speediance will properly store and reasonably use your personal information.

5.4.2. When uploading or publishing information exchange content using this software or/network service, please carefully consider the privacy of the content. You can set the scope of information you upload or publish through this software or/network service at the time of publication. During your use of this software or/network service, you have the right to delete the content you have already published at any time. If you wish for us to take measures to delete the information you have published or made public, you can contact us (after-sales@speediance.com) and submit your request. We will process and respond to your application as soon as we receive it.

5.4.3. Based on specific business or functional needs, Speediance may share your information with third parties during cooperation. You can click on the "Third-party Information Acquisition List" to obtain detailed information about third parties. Speediance does not provide user information we hold to other information processing subjects. If Speediance will provide user personal information to third-party information processors, we will inform you of the information and purpose of use of the third-party information processors through pop-ups, emails, announcements, etc., and obtain your consent.

For example, we may call on SDKs from Honor, Huawei, Meizu, OPPO, VIVO, Xiaomi, WeChat, Facebook, and Twitter for notifications. This information notification function is used to send messages to users, including reminding users to complete exercise plans, to improve the functionality and content of our software and services to enhance user experience and provide better services.

Currently, the subjects and situations of our authorized information sharing mainly include the following types:

(1) Speediance affiliates. Our affiliated companies, for purposes consistent with this policy.

(2) Personal trainers of Speediance. When conditions permit, when you choose to participate in one-on-one personal training courses or other interactive plans and services through Speediance services. For example, we will share your exercise history, pre-class survey responses, and other information provided by you with your coach before the course starts, with your permission.

(3) Other Speediance users and the public. When you provide content to your public user profile for sharing with other users (including through activating the camera on Speediance devices), or voluntarily disclose it in any other way that other users or the public can view, other Speediance users or the public may be able to access or view this information. Additionally, your username will be displayed to other users through the Speediance APP, and with your permission, other users can contact you through Speediance services. For example, if you choose to add other users as friends or engage in interactions, these other users may see your videos, personal profile data, fitness, and performance data, and may comment on your exercises. Furthermore, any content you publicly post through the Speediance APP or platforms related to Speediance services (including on third-party services such as social media platforms) may also be public. For example, if the Speediance device you use is equipped with a camera, and you choose to activate the camera on the Speediance device during exercise, with your permission, other users of our service may be able to see the videos you share during exercise or in future exercises. We do not control how other users or third parties use any personal information you provide to them. Please note that any information you publicly post may be cached, copied, screenshotted, or stored elsewhere by others (such as search engines) before you edit or delete it again.

(4) Speediance service providers. The scope of Speediance service providers includes but is not limited to: other companies and individuals who represent us to provide services or perform tasks to help us operate Speediance services or our business, such as customer support, hosting, analytics, mobile application metrics, email delivery, marketing, and database management services, music integration services, our extended warranty service providers, and payment processors. However, these third parties may only use your personal information within the scope authorized by the contracts we have signed with them, and we will, within your permission, authorize third parties to use your personal information minimally for your benefit.

(5) Third-party platforms. Social media platforms or other third-party platforms that you connect to Speediance services and authorize us to share your information with (for example, when you use options to access Speediance services by logging in through third-party platforms).

(6) We obtain the Mac/androidID/IDFA/OPENUDID/GUID of all users through user login to our Speediance APP, covering all our users, and optimize our software functions through statistical user usage data to serve our device adaptation and content arrangement, while also ensuring the security of user accounts.

(7) Professional advisors. Such as lawyers, auditors, and insurance companies, when they provide professional services to Speediance as necessary, at the request of professional advisors, user data will be provided.

(8) Law enforcement, judiciary, and other national agencies and related rights holders. We sincerely believe that this is conducive to compliant operation. When necessary, sharing information with national agencies and related rights holders such as law enforcement and judicial agencies is necessary and appropriate.

(9) Business transfers. Participants in business transactions (or potential transactions), such as divestitures, mergers, consolidations, acquisitions, reorganizations, sales, or other disposals (including those related to bankruptcy or similar procedures) of all or any part of the business or assets or equity of Speediance or our affiliates. In any of these cases, user information (including personal information) may be one of the assets transferred to or obtained, or accessed by third parties.

5.5. Disclosure of Your Information

5.5.1.When Speediance collaborates with third parties to hold events or conduct promotions, third parties may be responsible for delivering gifts or promotional items to users. With your authorization, we will disclose your mailing and logistics information to these third parties. You can click on the "Third-Party Information Access List" to obtain detailed information about these third parties.

5.5.2.With the user's written consent, Speediance has the right to use the user's personal information directly. Written consent can take various forms, including but not limited to: handwritten or drawn paper forms, emails, digital documents, electronic data, and other electronic formats.

5.5.3. Under the following circumstances, Speediance may directly use or disclose the user's private information without notifying the user or bearing any responsibility:

(1) To eliminate imminent dangers to the user's life, body, or property.

(2) To prevent or stop damage to Speediance's or another third party's rights and interests.

(3) For disclosure in the public interest.

(4) For compliance with laws, regulations, litigation, dispute resolution needs, or in response to requests from administrative or judicial authorities according to the law.

5.5.4. During your registration and use of this software and/or network services, with your consent and authorization, we will collect your personal information (including but not limited to IP address, MAC address, IMEI, device model, Android ID, software installation list, time zone, network status (WiFi, etc.), operating system information, browser model and version, etc.). This information will be analyzed for user data purposes and may be used by Speediance or third parties for market promotion. The specific content of the information obtained by third parties will be detailed to you when we obtain your consent, allowing you to choose whether to agree. 6.3.2. Speediance ensures comprehensive security control over data through confidentiality agreements for information handlers, monitoring, and auditing mechanisms.

6.3.3. Speediance has established a Data Security Committee and dedicated Information Protection Department, as well as a Data Security Emergency Response Organization, to promote and ensure the security of personal information.

6.3.4. Speediance conducts security and privacy protection training courses to enhance employees' awareness of security and understanding of personal information protection policies and related procedures.

6.4. User Responsibility in Information Protection

In addition to Speediance's efforts to protect your information, you should also take responsibility and effectively protect your own privacy information, properly safeguard your confidential information on Speediance, and ensure the security of the network equipment you use.

6.5. User Rights to Update and Delete Personal Information

During your use and acceptance of Speediance products and services, you have the right to update or delete your personal information. When you request Speediance to delete your private information, you can contact Speediance through the provided contact information to submit your request. Upon identity verification, Speediance will promptly process your request.

6.6. Please be aware that while Speediance will make every effort to ensure the security of any information you send to Speediance, the internet environment is not 100% secure. Speediance will not be responsible for any risks or losses that arise from or are related to this.

6.7 In the unfortunate event of a personal information security incident, Speediance will promptly inform you in accordance with legal and regulatory requirements. This notification will include the basic information about the security incident, its potential impact, the measures Speediance has taken or will take to address it, suggestions for you to independently prevent and reduce risks, and remedial measures for you. Speediance will notify you of the incident-related procedures through email, letter, phone, push notifications, etc. If it is difficult to inform each individual personally, Speediance will use reasonable and effective means to issue a public announcement. Additionally, Speediance will report the handling of personal information security incidents to regulatory authorities as required.

 

7. Things you can do

7.1. Opting Out of Marketing Communications. If you have provided your email address to Speediance and wish to stop receiving marketing emails, please click the unsubscribe link at the bottom of any of our email communications. Note that even if you opt out of marketing communications, Speediance may still contact you for non-marketing reasons related to Speediance services or your subscription, such as for password recovery or service requests.

7.2. Account Information. If you have registered for an account through purchase, subscription, or other means, you can access your Speediance account at any time after logging in, and you can modify, update, and change your account settings through Speediance services. When you update information, Speediance may retain a copy of the unmodified information in its records. You can also contact Speediance using the provided contact information to request the deletion of certain account information. After you delete such information from your account, some information may remain in Speediance’s records, and public activities on your account before deletion may still be publicly accessible.

7.3. Message Notifications. You acknowledge and agree that Speediance may send notifications to the contact information you provided (e.g., email, phone number) during product and/or service use. These notifications can include reminders for scheduled training days, incomplete course reminders, and notifications of activities of interest. If you do not wish to receive these messages, you can turn off the "Exercise Reminders" in the message center or disable message notifications in your phone settings. If you do not want Speediance to use third-party platforms’ auto-start functions (as listed in the "Third-Party Information Access List") to ensure proper reminders and notifications, you can disable the auto-start function through your phone setting.

7.4. Most browsers allow you to delete or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Note that if you disable cookies, Speediance services may not function properly. 7.5. No Tracking Information

7.6. Choosing Not to Share Your Personal Information. If you do not provide the reasonably necessary information required for Speediance services, Speediance may not be able to provide you with those services or certain features. When Speediance requests information, it will inform you of the necessary information needed to receive Speediance services.

7.7. Third-Party Platforms. If you choose to connect to Speediance through your social media account or another third-party platform, you can limit the information Speediance receives from that platform through your account settings on the platform. If you revoke Speediance's ability to access information from a third-party platform, this will not affect information Speediance has already received from that platform.

7.8. Account Deletion. You can choose to delete your account, but please note that this action is irreversible. Once your account is deleted, you will no longer be able to log in and use the related services. All information and data stored and used under your account will be permanently deleted. Proceed with caution when deleting your account. Additionally, account deletion does not exempt or reduce any responsibilities and actions taken under the account before its deletion.

7.8.1. Account Deletion Process

To delete your account, go to the "My" page, select "Setting" in the top right corner, then choose "Delete Account" on the "Setting" page. Alternatively, you can contact us at after-sales@speediance.com for assistance.

7.8.2. Irreversibility of Account Deletion

Once you choose to delete your account, you will not be able to retrieve any information or data that was stored and used under that account.

 

8. Protection of children under 18 years old

8.1 Our products and app primarily target adults, and we have no intention of collecting personal information from minors (especially children). If we become aware of collecting information from minors (especially children), we will take appropriate measures to protect this information and may restrict or terminate services.

8.2 As birth year and date are not required information during app registration, we cannot identify users' ages. If you are a minor, before using this product or service, you should obtain consent from your guardian and use and submit personal information under the full guidance of your guardian, limiting the scope of authorized information as much as possible. We promise to collect only the minimal necessary personal information with the guardian's consent. In the aforementioned case, we will collect and use the personal information of minors only when permitted by laws and regulations in the software usage area, with explicit consent from the guardian, or when necessary to protect minors.

8.3 If you, as a guardian, allow minors (including children) under your supervision to use Speediance products or services, we require you to carefully read our privacy policy, accompany and guide minors on how to safely use our products and services. Guardians can access children's personal information and request changes or deletions at any time by contacting us (after-sales@speediance.com). We promise to continually review and update our privacy protection measures to ensure the proper protection of children's privacy.

8.4 For personal information that may involve minors (especially children), we further take the following measures for protection:

(1) For personal information collected from minors (especially children), besides complying with the provisions of this privacy policy regarding user personal information, we adhere to the principles of legality, necessity, informed consent, clear purpose, security guarantee, and lawful utilization, strictly follow the requirements of laws and regulations in the software usage area for storage and use, and will not exceed the necessary limits and reasonable duration for achieving the collection and use purposes. After the expiration, the personal information of minors (especially children) will be deleted or anonymized.

(2) When you, as a guardian, choose to use our related services for the supervised minors (especially children), we may need to collect personal information of the supervised minors (especially children) from you to fulfill the necessary services. 9.3 Speediance shall not be liable for any leakage, loss, theft, or alteration of user or third-party privacy information, or any resulting legal disputes or consequences caused by government regulation, equipment damage, or other factors affecting the normal operation of the network.

9.4 Speediance shall not be liable for any leakage, loss, theft, or alteration of user or third-party privacy information, or any resulting legal disputes or consequences caused by other websites linked to Speediance.

9.5 Speediance shall not be liable for any leakage, loss, theft, or alteration of user or third-party privacy information, or any resulting legal disputes or consequences caused by the user's violation of the guarantees and commitments in this privacy policy.
