Applicable Devices: Limited to genuine GYM2 and GYM2S smart fitness equipment originally purchased through Speediance's official U.S. Direct-to-Consumer (DTC) channels or authorized dealer networks (including officially certified refurbished devices, hereinafter collectively referred to as the “Device” or “Devices”).

Service Basis: These Service Terms ("Terms") constitute a supplementary extended warranty agreement to the Speediance Limited Manufacturer’s Warranty Policy. Provisions in these Terms regarding the exclusive value-added benefits of Speediance Care shall prevail. In the event of any conflict, inconsistency, or ambiguity regarding general hardware warranty coverage and exclusions, the Speediance Limited Manufacturer’s Warranty Policy shall govern. The after-sales repair service standards applied during the Extended Warranty Period shall be identical to those of the original two (2) year basic manufacturer warranty.

This Service Terms forms a legally binding contract between Speediance and the User. It is governed by applicable U.S. federal laws, including the rules of the Federal Trade Commission (FTC) and the Magnuson-Moss Warranty Act, as well as applicable state laws governing extended service contracts. By purchasing, activating, or utilizing any benefits under Speediance Care (the "Plan"), you acknowledge that you have fully read, understood, and unconditionally accept all provisions of these Terms and the Speediance Limited Manufacturer’s Warranty Policy.

I. Core Terminology Definitions  

The definitions of all terms set forth in these Terms are referenced against the prevailing industry standards for extended warranty services within the U.S. and are hereby specified in conjunction with the Speediance Care U.S. Business Rules as follows:

All terms utilized herein shall be interpreted in accordance with standard U.S. extended warranty industry practices and Speediance Care operational guidelines:

1. Care Service / This Plan / These Terms means the specific Speediance Care extended service plan purchased by you (either the Speediance 3-Year Care or Speediance 4-Year Care), subject to the provisions detailed herein.

2. Manufacturer’s Standard Warranty Period means the original two (2) year limited hardware warranty provided by the manufacturer, commencing at 12:00 AM local time on the documented date of Device delivery. Specific terms are governed by the Speediance Limited Manufacturer’s Warranty Policy.

3. Extended Warranty Period means the specified timeframe immediately following the expiration of the Manufacturer’s Standard Warranty Period, during which Speediance provides extended coverage for key components. The Extended Warranty Period is twelve (12) months for Speediance 3-Year Care, and twenty-four (24) months for Speediance 4-Year Care.

4. Term of Coverage means the total combined duration of the Manufacturer’s Standard Warranty Period and the Extended Warranty Period.

Speediance 3-Year Care:

  • Duration: 36 months;
  • Effective date: The device receipt date;
  • Expiration date: the end of the 36th month from the device receipt date.

Speediance 4-Year Care:

  • Duration: 48 months;
  • Effective date: The device receipt date;
  • Expiration date: the end of the 48th month from the device receipt date.

5. Device Serial Number (SN) means the unique product identifier affixed to the Device, which serves as the primary credential for Plan activation, identity verification, and claims processing.

6. Authorized Service Providers (ASPs) means professionally certified third-party service providers contracted by Speediance to perform on-site diagnostic and repair services. Only ASPs are authorized to perform covered repairs under this Plan.

7. Plan Administrator means Speediance Inc., the entity responsible for Plan sales, rights administration, and the processing of all service claims. All repairs must receive prior authorization from the Plan Administrator.

8. Original Purchaser / You / User means the individual who initially purchased the Device via official Speediance channels or authorized dealers. The Original Purchaser is the sole legal beneficiary of this Plan.

9. Plan Price means the total monetary amount remitted for this Plan, as indicated on the Order Confirmation.

10. Order Confirmation means the official invoice, receipt, or confirmation email issued by Speediance upon purchase of the Plan, detailing the coverage period, plan tier, and Purchase Price.

11. Pre-existing Conditions means any malfunctions, damages, or latent defects present in the Device prior to the purchase of this Plan, including unresolved issues reported during the Manufacturer’s Standard Warranty Period.

12. Standard Service Area means geographical locations within the United States that are within a 150-kilometer (approximately 93-mile) one-way driving radius from a Speediance Authorized Service Center (ASC).

13. Remote Areas means U.S. overseas territories including Alaska, Hawaii, Puerto Rico, Guam, and the U.S. Virgin Islands, as well as locations within the contiguous United States that are greater than a 150-kilometer (approximately 93-mile) one-way driving distance from a Speediance Authorized Service Center (ASC), as calculated via Google Maps.

II. Service Versions and Coverage Duration

2.1 Product Rights and Specifications  

Speediance Care offers two official service versions for U.S. market users. For all versions, the aftersales service standards during the extended warranty period are identical to the manufacturer’s original 2 year warranty. In addition to core component extended warranty coverage, the plan includes exclusive valueadded benefits. The standard retail prices, coverage periods, and detailed benefit outlines for both versions are as follows:

Covers core hardware components, including motors, drive boards, screens, mainboards, power supplies, pulleys and sliding sleeves, casters, pedals, brackets, and other related core hardware components. The scope of coverage hereunder is fully consistent with that of the original factory basic warranty.

On-Site Maintenance Entitlements

One (1) complimentary on-site service instance. Includes: round-trip travel fees (within a 150km radius), labor fees for certified technicians, and costs for original spare parts required for functional restoration.

Tension Rope Replacement

Within the entire 36-month coverage period, one (1) pair of original Speediance resistance bands may be claimed free of charge (including standard shipping fees).

Exclusive Rights and Interests of Wellness+ Membership

One (1) month of full-featured Wellness+ Membership is granted complimentary, including all functions such as customized courses, personalized training plans, and exclusive training communities.

VIP Express Channel Service

During the entire thirty-six (36)-month coverage period, the customer shall be entitled to priority handling of work orders (which shall be placed at the top of the processing queue), with an initial response within twelve (12) working hours, and completion of damage assessment together with the issuance of corresponding solutions within forty-eight (48) hours.

Voucher Expiry: 12 months from the date the email is sent.

Member Rights Expiry: 1 month after activation of the membership rights.

 

VIP Express Channel Service

Effective from the Care order purchase date.

 

 

3-Year Version: Expiring on the 36th month from the device receipt date.

4-Year Version: Expiring on the 48th month from the device receipt date.

 

2.3 Special Instructions for Officially Certified Refurbished Devices

Officially certified refurbished devices (hereinafter referred to as "Refurbished Devices") shall be eligible for the purchase of Care Services only during the manufacturer's warranty period (commencing at 12:00 AM on the date of completion of refurbishment and delivery to the user). The scope of coverage, service standards, and value-added benefits applicable to Refurbished Devices under the Care Services shall be identical to those applicable to new devices. However, any cosmetic imperfections (such as light scratches, paint chips, or wear) on Refurbished Devices that do not affect the functional use of the device are excluded from the Care Service coverage.

III. Eligibility and Effectiveness

1. Basic Purchase Eligibility: The purchase of Care Services is exclusively restricted to the Original Purchaser during the device's original two-year manufacturer’s limited warranty period. Once the device’s original limited warranty has expired, the eligibility to purchase Care Services shall be permanently terminated.

2. Device Condition Requirements: At the time of purchasing Care Services, the device shall be in optimal operating condition (fully functional and free of cosmetic or structural defects). The device shall be free of unauthorized disassembly, uncertified repairs, liquid damage, physical impact, or any unresolved functional faults. device that previously experienced malfunctions during the original manufacturer's limited warranty period remains eligible, provided such malfunctions shall have been fully remediated to original factory standards via official warranty channels.

3. Binding Rules: A strict policy of one Care Service plan per Serial Number (SN) for the functional life of the device shall be enforced. The accumulation or stacking of multiple service plans is strictly prohibited. For the avoidance of doubt, a Speediance 3-Year Care plan is not eligible for an upgrade to a Speediance 4-Year Care plan.

4. Non-Transferability: The Care Service shall be strictly bound to both the device SN and the original purchaser’s user account and is non-transferable, non-assignable, and non-divisible. It may not be transferred in connection with any resale, gift, lease, or other disposition of the device. This provision is consistent with the non-transferability of the manufacturer’s base warranty. Upon any change in ownership of the device, all associated Care Service benefits shall automatically terminate, and no services shall be provided to any subsequent owner.

5. Authorized Purchase Channels: The Care Service may only be purchased through the official Speediance U.S. direct-to-consumer (DTC) website or authorized distributors. Speediance reserves the right to refuse to provide services for any Care Service purchased through unauthorized or unofficial channels and shall have no obligation to provide refunds or perform any related obligations.

6. Territorial Limitations: Performance of these Care Services is strictly limited to the territorial boundaries of the United States. No international or global warranty services are provided hereunder. For any repairs requested or conducted outside the designated service area, the user shall be solely and exclusively responsible for all associated costs, including but not limited to customs duties, import clearance fees, international transportation, and warehousing expenses, in full alignment with the original manufacturer’s limited warranty policy.

IV. Core Service Benefits

All benefits under this Service are included in the plan price. Services within the coverage scope are provided without any hidden deductibles or base service fees. The repair standards are fully consistent with those of the manufacturer’s base warranty.

4.1 Extended Warranty for Core Components (Same Standards as Manufacturer’s Base Warranty)

The extended warranty shall be activated only upon binding the order number. The order number will be sent to your registered email address after purchase. After purchase, within the total coverage period, we will provide repair services consistent with the manufacturer’s base warranty standards, covering the following scenarios:

1. Functional failures of core device components (including but not limited to motors, driver boards, screens, motherboards, power supplies, pulleys, rollers, pedals, and frames) caused by quality defects in materials or workmanship.

2. The following accessories are not covered under the Care extended warranty and are only entitled to the manufacturer’s one (1)-year base warranty. No free repair services will be provided after the expiration of the base warranty period: rowing machine, flat bench, adjustable bench, Bluetooth ring, barbell hooks, barbell shoulder pad, adjustable barbell, rowing handle, ankle straps, triceps rope, general handles, ski handles, smart handles, yoga mat, weightlifting belt, extension straps, accessory storage rack, ball joints, resistance band kit.

3. Activation Method: The Service shall be activated upon binding the order number:

(1) Log in to your account on the Speediance device;

(2) Navigate to: Home → Profile → System Settings → My Device → Speediance Care Service;

(3) Enter the Care order number provided in the email;

(4) Click to confirm activation. When the page displays “Extended Warranty Activated,” the activation process is complete, and the coverage period and benefit status can be viewed.

4.2 Complimentary Authorized On-Site Repair Service

During the extended warranty period (25–36 months), Speediance 3-Year Care entitles the user to one (1) complimentary authorized on-site repair service in total; during the extended warranty period (25–48 months), Speediance 4-Year Care entitles the user to two (2) such services in total.

This benefit applies only to device failures within the coverage scope of this Service, namely functional failures of core components (including but not limited to motors, driver boards, screens, motherboards, power supplies, pulleys, rollers, pedals, and frames) caused by defects in materials or workmanship.

1. This complimentary on-site repair service applies only to areas within a one-way driving distance of 150 km (approximately 93 miles) from an authorized Speediance service center, calculated based on GPS driving distance from the service center to the user’s device location. Within this range, service call Fees, certified technician labor costs, and original spare parts required for repair are fully covered, and the user shall not bear any of the foregoing costs.

2. For remote areas beyond 150 km (approximately 93 miles), the on-site service rules shall be implemented in strict accordance with Clause 5.1 “Remote Area Service Rules.” On-site service may be arranged only after remote diagnosis confirms that a complex core component failure requires a technician visit. The user shall bear additional mileage charges (at the rate of $1.5 per km or $2.5 per mile, calculated only for the portion exceeding 150 km (93 miles)). Technician accommodation costs, travel-related miscellaneous expenses (such as tolls, parking fees, and meal allowances), stair handling fees, device relocation costs, and all other non-basic repair expenses are not covered under this Service and shall be borne entirely by the user. The applicable fee standards will be disclosed to the user in writing prior to service, and service will be arranged only after user confirmation.

3.The above-mentioned accommodation, travel-related miscellaneous expenses, stair handling fees, device relocation costs, and all other non-basic repair expenses will be itemized and disclosed to the user prior to the on-site visit. The user must complete confirmation and payment / credit card pre-authorization before the technician is dispatched. If such confirmation or payment is not completed in a timely manner, we reserve the right to refuse to arrange the on-site service and shall not bear any liability.

4. After the complimentary on-site service entitlement has been used, the user may apply for paid on-site repair services in accordance with the manufacturer’s base warranty policy. All on-site repair services must be authorized by us in advance. We shall not bear any costs or liability for any unauthorized on-site repair services.

4.3 Complimentary Replacement of Original Resistance Bands

During the total coverage period, you are entitled to request one (1) complimentary pair of original Speediance resistance bands. We shall bear all standard shipping costs.

  • Effective date: the Care order purchase date;
  • Expiration date: the end of the 48th month from the device receipt date.

4.4 Wellness+ Membership Benefit

Upon purchase, you will receive a complimentary one (1)-month full-feature Wellness+ membership, including all membership features such as customized fitness courses, personalized training plans, and exclusive training communities. The redemption code will be sent to your registered email after purchase and shall remain valid for twelve (12) months from the date of issuance (calculated from the Care order purchase date).

Activation Method:

1. After successful purchase, a Wellness+ redemption code will be sent and labeled as a “Wellness+ Redemption Code.” Please keep it properly;

2. Activation path: Open the Speediance device or mobile app → My → Membership Redemption → Enter the redemption code;

3. Click to confirm activation. Once the page displays the membership validity period and benefit details, all membership features will be unlocked.

Note:

If you have already obtained a Wellness+ membership prior to purchasing the Care Service, the system will indicate that “you are already a member and cannot redeem the code.” It is recommended that you redeem the code after the existing Wellness+ membership expires.

4.5 VIP Priority Support Service

During the total coverage period, you will be entitled to exclusive priority customer services, including:

Priority handling of all consultation and service tickets;

Response within twelve (12) hours during working hours;

Completion of fault assessment and provision of a solution within forty-eight (48) hours after a repair request is submitted;

Within standard service areas, dispatch of an authorized technician within forty-eight (48) hours after the solution is provided; remote areas shall be subject to Clause 5.1 of these Terms.

  • Expiration date: the end of the 48th month from the device receipt date.

V. Service Application and Performance Procedures

1. Official Application Channels: You may submit service requests, benefit claims, or inquiries at any time through the following official channels:

2. Application Requirements: When submitting an application, you shall provide the Care purchase order number, registered user ID, and device serial number (SN) for verification of your service eligibility. You shall submit a service request within thirty (30) days of discovering a device malfunction. If timely submission is prevented due to force majeure, the time limit shall commence from the date such force majeure event ceases. All service requests shall be submitted within the total coverage period of this plan. We reserve the right to refuse any requests submitted after the expiration of the coverage period. To the extent permitted by law, any additional damage caused by serious delay in submission shall not be covered.

3. Initial Troubleshooting: Upon receipt of your request, we shall first attempt to identify and resolve the issue via telephone, email, online chat, or remote assistance. Where necessary, you may be instructed to install software updates. If the issue cannot be resolved through the foregoing methods, we shall provide a subsequent repair solution.

4. Prior Authorization Requirement: All repair services must be authorized by us in advance. Without such authorization, you shall not return the device or engage any third-party repair service provider. We reserve the right to refuse to bear any related costs or provide corresponding service benefits for any unauthorized actions.

5. Fault Assessment and Service Fulfillment:

For all repair requests, we shall complete fault assessment within forty-eight (48) hours and provide a repair solution;

For onsite repair requests within standard service areas, the dispatch of an officially certified technician and the scheduling of the visit shall be completed within forty-eight (48) hours. For remote areas, the coordination of service providers and the scheduling of the visit shall be completed within fourteen (14) business days.

Spare parts replacement / resistance band claims: upon successful verification, original parts shall be shipped within forty-eight (48) hours, and tracking information will be provided simultaneously. We shall not be liable for any loss caused by incorrect or incomplete shipping information provided by you.

6. Warranty for Repaired or Replaced Parts: Depending on the specific damage, we may provide repair services, including repairing defective parts or replacing them with officially certified refurbished parts of the same type. Within the remaining coverage period, any replaced product or part shall continue to enjoy the same warranty scope as the original product.

7. Service Fulfillment and Benefit Deduction: Upon completion of the service and your acceptance, the corresponding service entitlement usage shall be deducted, and service records will be updated accordingly. All service records may be accessed through official channels.

5.1 Remote Areas Service Rules

For the purposes of these Terms, “Remote Areas” shall have the same meaning as defined in Section I, referring to locations within the 48 contiguous United States that are 150 kilometers or more (one-way) from an authorized Speediance service center, as well as Alaska, Hawaii, Puerto Rico, Guam, and the U.S. Virgin Islands. For onsite repair requests in Remote Areas, the following rules shall apply, consistent with the manufacturer’s base warranty policy:

1. receipt of the request, we will first provide complete remote technical support to diagnose the issue and determine whether it can be resolved through remote guidance or spare parts delivery;

2. If onsite repair is confirmed to be necessary, we will use commercially reasonable efforts to coordinate an authorized service provider in your area. If successfully arranged, any additional mileage charges and other payable costs shall be confirmed and paid in advance before scheduling the service;

3. If, despite commercially reasonable efforts, onsite repair services cannot be arranged, we will provide one of the following alternative solutions free of charge (at your option):

(i) expedited shipment of original spare parts together with official repair instructional videos (videos only, without real-time remote guidance); or

(ii) prepayment of labor costs for a locally selected licensed repair provider (subject to prior submission of technician qualifications and repair quotation). The subsidy shall be capped at USD 350 per incident and subject to our prior approval. Any amount exceeding the cap shall be borne by you;

4. If option (i) is selected, your free onsite repair entitlement will not be deducted; if option (ii) is selected, it shall be deducted as equivalent to a standard onsite repair service.

VI. Coverage Scope and Exclusions  

6.1 Covered Services  

This Care plan covers only the explicitly specified device failures and services below. Any services beyond this scope are excluded and remain subject to the original manufacturer’s warranty policy:

1. Free repair or replacement of core components due to material defects, workmanship issues, normal wear and tear, or electrical aging during the coverage period;  

2. Free onsite repair services within the agreed time-frame and service limits for covered failures;  

3. Free replacement of original resistance bands within the agreed time-frame and usage limits;  

4. Wellness+ membership benefits and VIP priority service within the agreed period.

6.2 Exclusions  

Speediance reserves the right to refuse service, deny benefit claims, and assume no refund or liability under any of the following circumstances:

6.21 Improper Use or Operation (Damage/Loss Caused by Subjective User Error)

1. Damage not caused by manufacturing defects, including improper installation, use, or disassembly, or failure to follow official instructions or manuals;  

2. Continued use after component failure causing further damage, including secondary or consequential damage (not covered);  

3. Unauthorized circuit modification, improper charger or power supply usage, or operation under low/defective battery conditions;  

4. Indirect damage caused by improper installation or disassembly, including damage to personal property, walls, or flooring.

6.22 Unauthorized Modifications and Third Party Interference (Damage Caused by Private Modifications or Third-Party Accessories)

1. Unauthorized modification, disassembly, or repair, or use of nonofficial technical support resulting in damage;  

2. Intentional damage or unauthorized alteration (including tampering with operational data);  

3. Use of unauthorized thirdparty components causing damage due to compatibility or reliability issues;  

4. Failure or damage of any thirdparty products, including those integrated into Speediance products at your request.

6.23 Environmental and Force Majeure Factors (Damage caused by External Environmental Conditions, Sudden Environmental Changes, or Force Majeure Events)

1. Exposure to extreme environments such as high temperatures or corrosive conditions;  

2. Operation in environments with electromagnetic interference or interference from other wireless devices;  

3. Damage caused by force majeure events such as fire, flood, earthquake, or power failures;  

4. Improper storage, transportation, or handling, including fire, water damage, or lightning.

6.24 Normal Wear and Other Conditions (Excluding Damage caused by Natural Wear and Tear, Improper Usage Scenarios, and Non-Hardware-Related Issues)

1. Normal wear and tear or cosmetic damage not affecting functionality, including scratches, dents, rust, discoloration, or performance degradation not caused by manufacturing defects;  

2. Use of noncommercial products in commercial settings (e.g., gyms, hotels, or private training studios);  

3. Products or components with altered or removed identification labels are not eligible for warranty service;  

4. Any preinstalled or subsequently installed software is not covered under this warranty.

VII. Cancellation and Refund Policy

This Policy complies with the rules of the U.S. Federal Trade Commission (FTC) and applicable state laws governing extended warranty services. All approved refunds will be returned to the original payment method within fifteen (15) business days.

7.1 Valuation of Bundled Product Components

Speediance Care is a bundled product that includes multiple benefits. For the purpose of refund calculations, the Manufacturer’s Suggested Retail Price (MSRP) of each component is as follows (where state law provides otherwise, such law shall prevail):

Original Resistance Bands (tangible product): $59.99  

Wellness+ Membership (digital benefit): $24.99  

VIP Priority Support (service benefit): valued at $50 annually  

Official Onsite Repair Service (service benefit): fair market value of $350 per service  

7.2 Full Refund Within 60-Day Cooling-Off Period

Within sixty (60) days from the date of purchase, provided that no Care service benefits have been activated or utilized (including but not limited to: no redemption of resistance bands, no activation of Wellness+ membership, and no repair requests or VIP consultations), you may apply for a 100% full refund without any deductions.

7.3 ProRated Refund After Benefit Activation or After 60 Days

If any benefits have been activated or used, or if a refund is requested after sixty (60) days from purchase, the refund amount will be calculated as follows:

Refund Amount = [(Original Care Purchase Price − Value of Consumed Benefits) × (Remaining Coverage Days ÷ Total Coverage Days)] − Administrative Fee ($25)

Explanation of Consumed Benefits:

Physical Goods: Once the original resistance band enters the shipping process, a deduction of USD 59.99 shall apply. Due to hygiene and safety standards, returned resistance bands cannot be accepted to offset this deduction.

Digital Services: Once a Wellness+ membership code is redeemed or activated, a deduction of USD 24.99 shall apply.

Fulfilled Service Costs: Includes completed on-site repair services (USD 350 per visit) and related spare parts costs.

State Law Exceptions: In jurisdictions where the deduction of fulfillment costs is prohibited by law (including, without limitation, California, New York, Washington, and Florida), such fulfillment costs (USD 350 per visit) shall not be deducted when calculating the refund. However, the value of delivered physical or digital goods and the administrative fee shall still be deducted in accordance with applicable law.

7.4 Administrative Fee

Except in cases of full refunds, all refund requests are subject to an administrative processing fee of $25 (or 10% of the refund amount, whichever is lower). If applicable state law imposes a lower limit, such law shall prevail.

7.5 Coordinated Refunds with Hardware Returns

1. If you return the device for a full refund within the manufacturer’s coolingoff period, the Care service may also be fully refunded without deductions.  

2. If the device is returned due to quality issues, the Care service refund will be calculated on a prorata basis according to the remaining coverage period.  

3. Upon completion of the device return, all associated Care service benefits will be immediately and permanently terminated.  

7.6 Loss Cap

If the calculated refund amount is negative (i.e., the value of consumed benefits exceeds the purchase price), the refund amount shall be deemed $0. No additional payment will be sought from you beyond the original amount paid.

7.7 Cancellation Initiated by the Company

1. We may terminate this Plan by providing thirty (30) days’ prior written notice to your registered email address under the following circumstances:  

Regulatory Requirement: The relevant regulatory authority requires the program to be terminated.

Compliance Changes: Any change in the program operator’s compliance status renders the existing agreement unenforceable.

Refund Settlement: In such cases, refunds shall be calculated pro-rata based on the remaining coverage period, and the value of delivered physical or digital benefits (resistance band USD 59.99; membership USD 24.99) and any incurred fulfillment costs shall be deducted, except in jurisdictions where deduction of fulfillment costs is prohibited by law.

2. We reserve the right to immediately terminate this Plan without refund and require payment of all service costs incurred if:  

    You fail to pay any due amounts under this Plan within fifteen (15) days after written notice; or  

    You materially breach these Terms, including but not limited to intentional damage, unauthorized modification, or misuse of the device that increases service risk.  

7.8 Termination of Benefits Upon Refund

Upon completion of any refund, all Care service benefits associated with the device will be immediately and permanently terminated. You will no longer be entitled to claim any unused benefits or submit repair requests under this Plan. If the device remains within the original manufacturer warranty period, you may continue to seek service through the manufacturer’s warranty channels. Care benefits are nontransferable, nonredeemable for cash, and nonreinstatable.

VIII. Responsibilities and Obligations of Users

This section is fully consistent with the Speediance Limited Manufacturer Warranty Policy:

1. Duty to Review Terms: You shall carefully read all the contents of these Terms to fully understand the scope of coverage, limitations, exclusions, and your obligations under this Plan.

2. Maintenance Obligation: You shall use, maintain, and service the equipment in accordance with the requirements set forth in the original manufacturer’s user manual to ensure that the equipment remains in normal operating condition.

3. Documentation Retention: You shall properly retain all relevant documents, including but not limited to the order confirmation for this Plan, the original purchase invoice for the equipment, and maintenance service records. These documents must be provided as requested when applying for service.

4. Data Backup Responsibility: Prior to submitting the equipment for repair, you are responsible for backing up all personal data stored within the device. We shall not be held liable for any loss or disclosure of data occurring during the repair process.

5. Packaging Responsibility: If you are required to return the equipment for repair, please package the device according to the official standard packaging guidelines. You shall bear full liability for any transit damage resulting from improper packaging.

6. Inspection Obligation upon Receipt: Upon receipt of the repaired or replaced equipment, you shall inspect the condition of the equipment within seventy-two (72) hours. Failure to provide feedback within this period shall be deemed as your acknowledgment that the equipment is in good condition.

7. Product Storage Policy: If the product cannot be delivered due to reasons such as an incorrect delivery address provided by you or failure to sign for receipt, we will provide free storage for thirty (30) days. Thereafter, a storage fee of $30 per day shall be charged. If the product remains undelivered after ninety (90) days, we reserve the right to dispose of the product in accordance with local laws and after issuing a final written notice. The proceeds from such disposal shall first be used to offset outstanding fees, and any remaining balance shall be handled in accordance with applicable laws.

8. Obligation for Compliant Use: If you use the product in violation of official instructions or the product user manual, or use the product for any illegal purpose, we reserve the right to terminate the Care Service and the original manufacturer’s limited warranty service.

IX. Limitation of Liability

Speediance does not provide any warranties other than those expressly set forth in these Terms and the Manufacturer’s Limited Warranty, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, or any warranties arising from course of dealing, usage, or trade practices.

1. Except as otherwise required by non-waivable mandatory provisions of applicable U.S. law, Speediance’s total cumulative liability under this Care service shall not exceed the original amount actually paid by you for the Care service. We shall only be liable for obligations expressly stated in these Terms. Any oral statements, representations, promotional materials, or third-party sales commitments beyond the scope of these Terms shall not be legally binding unless confirmed in writing and officially stamped by Speediance.

2. In cases where personal injury (including death) or property damage is directly caused by Speediance’s willful misconduct or gross negligence, we shall assume liability in accordance with applicable laws. We shall not be liable for any losses caused by your own fault, violation of these Terms, or the fault of any third party.

3. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of use of the device, interruption of fitness plans, lost wages, loss of expected profits, or loss of goodwill. These Terms are subject to mandatory laws of the respective U.S. states.

4. Third-Party Liability Waiver: If damage to the device is caused by a third party and we have provided you with free repair or replacement parts, you agree to cooperate with us in assigning the right of recovery for such repair costs to Speediance, so that we may recover the actual repair costs from the responsible party.

X. State Law Compliance Statement

These Terms shall be governed by U.S. federal law and the laws of the state where the device was originally purchased. If any provision of these Terms conflicts with mandatory consumer protection laws or extended warranty regulations of the state of purchase, such conflicting provision shall be governed by the applicable mandatory state law, while the remaining provisions shall remain in full force and effect.

Certain states do not permit limitations on implied warranties, limitations on recovery of consequential damages, or restrictions on refunds following substantial claims. To the extent any such limitation is prohibited by applicable law, such limitation shall not apply to users residing in such states.

XI. Dispute Resolution

The dispute resolution provisions of these Terms shall remain fully consistent with those governing Speediance device sales and the Manufacturer’s Warranty Policy:

Any dispute, claim, or controversy arising out of or in connection with this Care service shall first be resolved through amicable negotiation between the parties;

If negotiation fails, the dispute shall be submitted to a court of competent jurisdiction in the state where the device was originally purchased, and shall be governed by the substantive laws of that state (excluding conflict of laws principles);

For disputes involving amounts less than USD $10,000, you may choose to file a claim directly in a small claims court within your jurisdiction without prior negotiation, and we will fully cooperate with the procedures of such court.

XII. General Legal Provisions

1. Entire Agreement: These Terms, together with the Speediance Manufacturer’s Limited Warranty Policy and your order confirmation, constitute the entire agreement between you and us regarding this Care service, and supersede all prior oral or written representations and agreements. No agent is authorized to modify or waive any provision of these Terms. Any additional representations not confirmed in writing and officially stamped by us shall have no legal effect.

2. Severability: If any provision of these Terms is held by a competent authority to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the validity, legality, and enforceability of the remaining provisions shall not be affected.

3. Privacy Protection: We strictly comply with the California Consumer Privacy Act (CCPA/CPRA) and other applicable U.S. federal and state privacy laws. We only collect and use personal information necessary to perform the Care service. You may request access to, correction of, or deletion of your personal information at any time through official customer service channels, and we will respond within the legally required timeframe.

4. Amendment Disclaimer:We reserve the right to amend these Terms in accordance with changes in laws, regulations, or service resources. Any amendments shall apply only to newly purchased Care services after the effective date of such amendments and shall not affect services already purchased and in effect. We will not unilaterally reduce any vested user rights through such amendments.

5. Assignment of Contract: We may assign all or part of our rights and obligations under this Plan at any time by providing at least thirty (30) days’ prior written notice to your registered email address. We will ensure that the assignee has the necessary qualifications and capabilities to perform all obligations under this Plan. You shall have the right, within fifteen (15) days of receiving such notice, to raise reasonable objections to the assignee and terminate this Plan by written notice, and receive a refund in accordance with Section 7.3 (Pro-Rated Refund After Benefit Activation or After 60 Days). Upon assignment, the new obligor shall fully assume all obligations under these Terms, and your rights and benefits under this Plan shall remain unaffected. You may not assign any of your rights or obligations under this Plan. This Plan is non-transferable.

6. Force Majeure: We shall not be liable for any failure or delay in performance due to force majeure events, including but not limited to earthquakes, fires, floods, wars, or government actions. We will make commercially reasonable efforts to notify you in advance and resume performance as soon as practicable after the force majeure event ends.
