Applicable Devices: Authentic Gym Monster series and Gym Nano smart fitness equipment (including officially certified refurbished units, hereinafter referred to as the "Equipment") purchased exclusively through Speediance's official DTC channels, Amazon channels, and authorized dealer channels within the United States.
Service Basis: These Service Terms ("Terms") constitute a supplementary extended warranty agreement to the Speediance Limited Manufacturer’s Warranty Policy. Provisions in these Terms regarding the exclusive value-added benefits of Speediance Care shall prevail. In the event of any conflict, inconsistency, or ambiguity regarding general hardware warranty coverage and exclusions, the Speediance Limited Manufacturer’s Warranty Policy shall govern. The after-sales repair service standards applied during the Extended Warranty Period shall be identical to those of the original two (2) year basic manufacturer warranty.
This document forms a legally binding contract between Speediance and the User. It is governed by applicable U.S. federal laws, including the rules of the Federal Trade Commission (FTC) and the Magnuson-Moss Warranty Act, as well as applicable state laws governing extended service contracts. By purchasing, activating, or utilizing any benefits under Speediance Care (the "Plan"), you acknowledge that you have fully read, understood, and unconditionally accept all provisions of these Terms and the Speediance Limited Manufacturer’s Warranty Policy.

I. Core Terminology Definitions

All definitions of terms in this section refer to the general standards of the U.S. extended warranty service industry and are clarified below in combination with the business rules of Speediance Care:
  1. Applicable Models and Product Scope: These Terms apply to Gym Monster, Gym Monster 2, Gym Monster 2S, Gym Monster 3, Gym Monster 3S, Gym Monster Ultra, and Gym Nano. The Care benefits enjoyed by the user (such as free machine replacement, original resistance cables, etc.) are strictly bound to the original factory specifications of the purchased model and cannot be transferred across models or redeemed for cash.
  2. Care Service / This Plan / These Terms: Means the specific Speediance Care extended service plan purchased by you (including Speediance 3-Year Care, Speediance 4-Year Care, or Speediance 5-Year Care), subject to the provisions detailed herein. This Care Plan is a service contract, not an insurance policy.
  3. Manufacturer’s Standard Warranty Period: Means the original two (2) year limited hardware warranty provided by the manufacturer, commencing at 12:00 AM local time on the documented date of Equipment delivery. Specific terms are governed by the Speediance Limited Manufacturer’s Warranty Policy.
  4. Extended Warranty Period: Means the specified timeframe immediately following the expiration of the Manufacturer’s Standard Warranty Period, during which Speediance provides extended coverage for core components. The Extended Warranty Period is twelve (12) months for Speediance 3-Year Care, twenty-four (24) months for Speediance 4-Year Care, and thirty-six (36) months for Speediance 5-Year Care.
  5. Term of Coverage: Means the total combined duration of the Manufacturer’s Standard Warranty Period and the Extended Warranty Period:
    1. Speediance 3-Year Care: Duration: 36 months total; Effective Date: Device receipt date; Expiry Date: 11:59 PM local time on the day immediately preceding the 36-month anniversary of the Machine Delivery Date
    2. Speediance 4-Year Care: Duration: 48 months total; Effective Date: Device receipt date; Expiry Date: 11:59 PM local time on the day immediately preceding the 48-month anniversary of the Machine Delivery Date
    3. Speediance 5-Year Care: Duration: 60 months total; Effective Date: Device receipt date; Expiry Date: 11:59 PM local time on the day immediately preceding the 60-monthanniversary of the Machine Delivery Date
  6. Device Serial Number (SN): Means the unique product identifier affixed to the Equipment host, which serves as the primary credential for Plan binding, benefit redemption, identity verification, and claims processing.
  7. Authorized Service Providers (ASPs) / Centers (ASCs): Means professionally certified third-party service agencies contracted by Speediance to perform on-site diagnostic and repair services. Only ASPs/ASCs are authorized to perform covered repairs under this Plan.
  8. Plan Administrator: Means Speediance Inc., the entity responsible for Plan sales, rights administration, and the processing of all service claims. All repairs must receive prior authorization from the Plan Administrator.
  9. Original Purchaser / You / User: Means the individual who initially purchased the Equipment via official Speediance channels or authorized dealers. The Original Purchaser is the sole legal beneficiary of this Plan.
  10. Plan Price: Means the total monetary amount remitted for this Plan, as indicated on the Order Confirmation.
  11. Order Confirmation: Means the official invoice, receipt, or confirmation email issued by Speediance upon purchase of the Plan, detailing the coverage period, plan tier, and Purchase Price.
  12. Pre-existing Conditions: Means any malfunctions, damages, or latent defects present in the Equipment prior to the purchase of this Plan, including unresolved issues reported during the Manufacturer’s Standard Warranty Period.
  13. Standard Service Area: Means geographical locations within the United States that are within a 150-kilometer (approximately 93-mile) one-way driving radius from a Speediance Authorized Service Center (ASC).
  14. Remote Areas: Refer to non-contiguous states and overseas territories of the United States including Alaska, Hawaii, Puerto Rico, Guam, and the U.S. Virgin Islands, as well as areas within the contiguous United States where the one-way driving distance to a Speediance ASC exceeds 150 kilometers (approximately 93 miles) as measured via Google Maps.

II. Service Versions and Coverage Duration

Speediance Care provides plan options for different Speediance models in the U.S. market. In addition to core component extended warranty coverage, each model includes matching exclusive value-added benefits as follows:

2.3 Special Instructions for Officially Certified Refurbished Devices

Refurbished Devices shall be eligible for the purchase of Care Services only during the manufacturer's base warranty period (commencing at 0:00 AM on the date of refurbishment completion and delivery). The scope of coverage, service standards, and value-added benefits applicable to Refurbished Devices shall be identical to those applicable to new devices. Cosmetic imperfections (such as light scratches, paint chips, or wear) that do not affect functional use are excluded from Care coverage.

III. Eligibility and Effectiveness

Care Services must be activated on the Equipment end to take effect and display benefits. Enter the order number (obtained via email or official website) on the machine screen (Path: Profile → Speediance Care → Activate Care).
  1. Basic Purchase Eligibility: The purchase of Care Services is exclusively restricted to the Original Purchaser during the device's original two-year manufacturer’s limited warranty period. Once the device’s original limited warranty has expired, the eligibility to purchase Care Services shall be permanently terminated.
  2. Device Condition Requirements: At the time of purchasing Care Services, the device shall be in optimal operating condition (fully functional and free of cosmetic or structural defects). The device shall be free of unauthorized disassembly, uncertified repairs, liquid damage, physical impact, or any unresolved functional faults. device that previously experienced malfunctions during the original manufacturer's limited warranty period remains eligible, provided such malfunctions shall have been fully remediated to original factory standards via official warranty channels.
  3. Binding Rules: A strict policy of one Care Service plan per Serial Number (SN) for the functional life of the device shall be enforced. The accumulation or stacking of multiple service plans is strictly prohibited. For the avoidance of doubt, a Speediance 3-Year Care plan is not eligible for an upgrade to a Speediance 4-Year Care plan.
  4. Non-Transferability: The Care Service shall be strictly bound to both the device SN and the original purchaser’s user account and is non-transferable, non-assignable, and non-divisible. It may not be transferred in connection with any resale, gift, lease, or other disposition of the device. This provision is consistent with the non-transferability of the manufacturer’s base warranty. Upon any change in ownership of the device, all associated Care Service benefits shall automatically terminate, and no services shall be provided to any subsequent owner.
  5. Authorized Purchase Channels: The Care Service may only be purchased through the official Speediance U.S. direct-to-consumer (DTC) website or authorized distributors. Speediance reserves the right to refuse to provide services for any Care Service purchased through unauthorized or unofficial channels and shall have no obligation to provide refunds or perform any related obligations.
  6. Territorial Limitations: Performance of these Care Services is strictly limited to the territorial boundaries of the United States. No international or global warranty services are provided hereunder. For any repairs requested or conducted outside the designated service area, the user shall be solely and exclusively responsible for all associated costs, including but not limited to customs duties, import clearance fees, international transportation, and warehousing expenses, in full alignment with the original manufacturer’s limited warranty policy.

IV. Core Service Benefits

4.1 Extended Warranty for Core Components

Adapts to the entire Speediance Gym series. During the coverage period, repair standards identical to the base warranty are provided for functional failures caused by material or manufacturing quality defects in core components (motors, driver boards, screens, mainboards, pulleys, casters, pedals, brackets).
Exclusions (covered only by the base warranty): Rowing machine, flat bench, adjustable bench, Bluetooth ring, barbell hooks, barbell shoulder pad, adjustable barbell, rowing handle, ankle straps, triceps rope, general handles, ski handles, smart handles, yoga mat, weightlifting belt, extension straps, accessory storage rack, ball joints, resistance band kit, and Gym Nano battery.

4.2 Complimentary Authorized On-Site Repair Service

This benefit applies exclusively to functional failures of original factory main components of the equipment (including motors, driver boards, screens, mainboards, sliding pulleys and sleeves, casters, foot pedals, brackets, etc.) caused by inherent quality defects in materials or manufacturing processes, excluding accessories. The on-site repair service entitlements for different models and Care versions are agreed upon as follows:
Speediance Gym Monster 3/3S / Gym Monster 2/2S / Gym Monster Options:
  • 3-Year Care: Entitles the user to one (1) complimentary authorized on-site repair service during the coverage period (Months 25 through 36).
  • 4-Year Care: Entitles the user to two (2) complimentary authorized on-site repair services during the coverage period (Months 25 through 48).
Gym Monster Ultra Option:
  • 5-Year Care: Entitles the user to two (2) complimentary authorized on-site repair services during the coverage period (Months 1 through 60).
On-Site Service Execution Rules:
  1. Standard Service Coverage Area: This complimentary on-site repair service applies only to areas within a single-trip driving distance of 150 km (approximately 93 miles) from a Speediance Authorized Service Center (ASC), calculated based on optimal GPS driving distance from the ASC to the user’s device location. Within this 150 km (93 miles) range, technician travel fees, certified technician labor costs, and original spare parts required for repair are 100% covered, and the user shall bear none of the foregoing costs.
  2. Remote Areas & Excess Mileage Surcharge: For remote areas beyond 150 km (approximately 93 miles), on-site service rules shall strictly follow Clause 5.1 "Remote Area Service Rules." On-site service may be arranged only after remote diagnosis confirms that a complex core component failure requires a technician visit. The user shall bear additional mileage surcharges (at the rate of $1.50 per km or $2.50 per mile, calculated only for the distance exceeding 150 km / 93 miles). Technician accommodation, travel-related miscellaneous expenses (such as tolls, parking fees, and meal allowances), stair handling fees, device relocation costs, and all other non-basic repair expenses are not covered under this benefit and shall be borne entirely by the user. Applicable fee standards will be disclosed to the user in writing prior to service, and service will be arranged only after user confirmation.
  3. Pre-Authorization and Payment: Itemized details and billing justifications for the aforementioned technician accommodation, travel-related miscellaneous expenses (tolls, parking fees, meal allowances), stair handling fees, device relocation costs, and all other non-basic repair expenses will be disclosed prior to the visit. The user must complete confirmation and payment / credit card pre-authorization before the technician is dispatched. If such confirmation or payment is not completed in a timely manner, Speediance reserves the right to refuse to arrange on-site service and shall bear no breach-of-contract liability.
  4. Post-Quota & Prior Authorization: After the complimentary on-site service visits have been redeemed, the user may apply for paid on-site repair services at standard rates in accordance with the Speediance Limited Manufacturer’s Warranty Policy. All on-site repair services must receive prior authorization from Speediance. Speediance shall bear no cost or liability for any unauthorized on-site repair services.

4.3 One-Time Free Full Machine Replacement Service (Applicable to Gym Nano)

During the Plan coverage period, the user is entitled to one (1) free full machine replacement service, with standard round-trip shipping fees 100% covered by Speediance. This one-time replacement applies exclusively to functional failures of the main unit or original factory core components resulting from inherent defects in materials or workmanship.
4.3.1 Qualifying Triggers (Effective upon meeting any single condition):
  1. Unrepairable Equipment Failure: Complex functional failures that remain unresolved after official remote diagnostics and spare parts replacement, requiring in-depth factory overhaul.
  2. High-Value Core Component Failure: Simultaneous failure of multiple core components where total repair costs are severely disproportionate to the machine's overall value.
4.3.2 Exclusions & Non-Applicability:
  1. Minor issues that can be effectively resolved through remote technical guidance or standard component replacement shall not trigger machine replacement benefits.
  2. Eligibility for machine replacement is subject to final technical inspection, assessment, and confirmation by Speediance authorized service engineers.
  3. Damage resulting from user error, unauthorized disassembly, uncertified repairs, improper modifications, unauthorized third-party servicing, commercial or excessive overload use, or force majeure events is strictly excluded from replacement service.
4.3.3 Replacement Equipment Rules:
  1. Replacement equipment will be of identical specifications and in fully functional operating condition. The replacement unit may be a new unit or a certified refurbished unit meeting manufacturer quality and performance standards.
  2. The replacement unit will match the functional specifications and hardware configuration of the original Equipment.
  3. Out-of-Stock Alternatives: In the event that the corresponding model is out of stock, Speediance will consult with the user to offer alternative solutions, such as placing the user on a backorder queue or providing an equivalent replacement solution.
4.3.4 Benefit Redemption, Ownership & Contract Term:
  1. Once the replacement unit enters the warehouse dispatch process, the one-time replacement entitlement is automatically redeemed, finalized, and non-restorable.
  2. Upon user receipt and sign-off of the replacement unit, legal ownership of the defective unit automatically transfers to Speediance, and the user must return the defective unit in full according to official guidelines.
  3. Upon fulfillment of the machine replacement service, the hardware replacement benefit under this Plan is permanently terminated. However, other value-added benefits—such as Wellness+ membership, VIP priority support, and free cable replacements—shall remain active until the original Plan coverage period expires.
  4. The replacement unit provided under this Plan shall inherit the remaining coverage period of the original Care Plan or receive a ninety (90) day warranty from the date of delivery, whichever is longer. The replacement unit does not restart or trigger a new two (2) year manufacturer's limited warranty.

4.4 Gym Nano Free Round-Trip Shipping Benefit (Applicable to Gym Nano)

4.4.1 Benefit Overview: During the active Care Plan coverage period, if the Gym Nano main unit or original factory core components suffer a functional failure due to defects in materials or workmanship requiring the machine to be returned to an Authorized Service Center (ASC) for repair, standard round-trip shipping fees shall be 100% covered by Speediance.
4.4.2 Execution Standards & Exclusions:
  1. Official Prepaid Shipping Labels & Service Tier: All mail-in repairs and equipment returns must utilize official prepaid shipping labels provided by Speediance and are restricted strictly to Standard Ground Shipping.
  2. Packaging Protection Requirements: Equipment must be packaged using original factory packaging or equivalent protective cushioning that meets safe transit standards. Secondary damage occurring in transit due to improper packaging is excluded from warranty coverage and free shipping benefits.
  3. Exclusions & Cost Recoupment: Speediance shall not cover full shipping costs, and reserves the right to recoup actual shipping expenses incurred, under any of the following circumstances: unauthorized C.O.D. shipments; units inspected and confirmed to have user-inflicted damage or no hardware defect; or user addresses located in Remote Areas (where excess mileage surcharges apply pursuant to Remote Area terms in Clause 5.1).

4.5 Complimentary Original Resistance Cable Replacement Benefit

The terms governing resistance cable replacements vary by Equipment model and Care Plan version as set forth below:
4.5.1 Gym Nano / Gym Monster / Gym Monster 2 / 2S / 3 / 3S Options:
During the Plan coverage period, the user is entitled to claim one (1) complimentary pair of original Speediance resistance cables, with standard shipping fees 100% covered by Speediance.
4.5.2 Gym Monster Ultra Option:
Gym Monster Ultra is equipped with an intelligent cable wear monitoring system. During the Plan coverage period, when a system alert is triggered or physical wear appears on the cables, the user is eligible for up to five (5) complimentary replacements with brand-new original resistance cables."
To eliminate safety hazards associated with damaged cables and prevent secondary distribution or unauthorized misuse, this benefit includes a mandatory return and destruction procedure for old cables, with Speediance bearing all return shipping freight.
4.5.3 Triggering, Claiming, Replacement, and Return Procedure:
  1. Qualifying Triggers: A free replacement claim may be initiated upon meeting either of the following conditions:
    1. System Smart Alert: A safety warning notification on the Equipment screen or mobile App indicating "High Risk" or "Replacement Recommended."
    2. Physical Visual or Tactile Wear: Visible defects on the cable surface that compromise safe operation, including damaged outer protective sheaths, exposed inner core wires, unraveling strands, extensive fraying or pilling, noticeable hardening, or abnormal texture/feel.
  2. Claim Submission: Take a screenshot of the system alert or a clear photo of the cable wear, and submit the claim directly via the Equipment screen or by contacting Customer Support. Upon approval, Speediance will dispatch new cables.
  3. Self-Replacement: Upon receiving the new cables, complete the replacement process using the official instructional video provided by Customer Support.
  4. Return & Recycling: Ship the replaced old cables back to Speediance using the provided prepaid return shipping label. Speediance covers all return shipping costs.

4.6 Exclusive Wellness+ Membership Benefit

Upon purchasing a Care Plan, you will receive a complimentary one (1) month Wellness+ Membership (Gym Monster Ultra includes a six (6) month Wellness+ Membership). The membership redemption code will be issued to your electronic Wellness+ Benefit Card upon activating your Care Plan. The voucher code is valid for 12 months from the date of issuance, expiring at 11:59 PM local time on the day immediately preceding the 12-month anniversary.
Wellness+ Membership Activation Instructions:
  1. Issuance: Following a successful purchase, activate your Care benefits using your order number. The Wellness+ redemption code will be deposited into your Wellness+ Benefit Card for claiming.
  2. Redemption Path: Open the Speediance Equipment interface or Mobile App → Profile (My) → Membership Redemption → Enter Redemption Code.
  3. Activation: Click "Confirm Activation." Once the screen displays the membership validity period and benefit details, all full-feature membership functions will be unlocked.
Note: If you hold an active Wellness+ Membership prior to purchasing Care, the system will prompt: "You are currently an active member and cannot redeem this code." We recommend waiting until your current Wellness+ Membership expires before redeeming your complimentary code.

4.7 VIP Express Support Service

During the Plan coverage period, you are entitled to exclusive priority customer service, including:
  • Omnichannel Ticket Prioritization: Support tickets submitted across all official channels will receive top-tier prioritization and expedited handling.
  • 12-Hour Response Time: Initial response from Customer Support within twelve (12) hours during business hours.
  • 48-Hour Diagnostic Resolution: Completion of diagnostic loss assessment and issuance of a formal repair solution within forty-eight (48) hours of a reported fault.
  • 48-Hour Engineer Dispatch: Within Standard Service Areas, an authorized certified service technician will be scheduled and dispatched within forty-eight (48) hours after a resolution plan is confirmed. Technician scheduling for Remote Areas shall strictly follow Clause 5.1 of these Terms.

V. Service Application and Performance Procedures

You may submit Care service benefit claims or requests through either of the following two methods:
A. On-Device Claim Submission (Recommended)
After activating Care Services on the Equipment using your order number, initiate repair or redemption requests directly within the respective benefit cards on the screen. You can track repair progress and view carrier tracking numbers directly on the Equipment interface.
B. Claim Submission via Official Customer Support Channels
You may also submit service requests, benefit redemptions, or inquiries at any time through the following official channels:

Execution Terms & Conditions:
  1. Submission Timelines: Service claims must be submitted within thirty (30) days of discovering an Equipment fault (or, in cases of force majeure, within thirty days after the force majeure event ceases). All claims must be submitted within the total coverage period of this Plan; Speediance reserves the right to deny claims submitted after Plan expiration. To the maximum extent permitted by applicable law, any secondary or expanded damage resulting from unreasonable delay in submitting a claim shall be excluded from coverage.
  2. Initial Remote Diagnostics: Upon receiving a claim, Speediance will first attempt to diagnose and resolve the issue via phone, email, live chat, or remote assistance, including instructing you to install software updates where applicable. If the issue cannot be resolved through remote troubleshooting, a formal repair solution will be issued.
  3. Prior Authorization Requirement: All repair services and returns must receive prior authorization from Speediance. Without prior authorization, you may not return the Equipment or engage third-party repair services. Speediance reserves the right to refuse coverage, deny benefit fulfillment, or reject reimbursement for any unauthorized repair actions or unauthorized returns.
  4. Diagnostic Assessment & Service Execution:
    1. 48-Hour Assessment: Speediance will complete a diagnostic assessment and issue a formal repair solution within forty-eight (48) hours of receiving a fault claim.
    2. Technician Scheduling: For on-site repair claims within Standard Service Areas, an authorized certified technician will be scheduled and an appointment arranged within forty-eight (48) hours of solution confirmation. For Remote Areas, service provider coordination and appointment scheduling will be completed within fourteen (14) business days.
    3. Parts Shipping & Cable Claims: Upon claim approval, original replacement parts or resistance cables will be dispatched within forty-eight (48) hours with tracking information provided. Speediance assumes no liability for lost shipments resulting from incorrect or incomplete delivery addresses provided by the user.
  5. Warranty Commitment for Repaired or Replaced Parts: Depending on the nature of the damage, Speediance may perform repairs using new or certified refurbished parts of equal performance. Replaced products or components shall inherit the warranty coverage of the original Equipment for the remainder of the active Plan coverage period.
  6. Benefit Deduction & Recordkeeping: Upon completion of the service and user sign-off/acceptance, the corresponding service benefit entitlement will be automatically deducted, and official service records will be updated. Users may access and view service history at any time through official support channels.

5.1 Remote Areas Service Rules

For the purposes of these Terms, “Remote Areas” shall have the same meaning as defined in Section I, referring to locations within the 48 contiguous United States that are 150 kilometers or more (one-way) from an authorized Speediance service center, as well as Alaska, Hawaii, Puerto Rico, Guam, and the U.S. Virgin Islands. For onsite repair requests in Remote Areas, the following rules shall apply, consistent with the manufacturer’s base warranty policy:
  1. Upon receipt of the request, we will first provide complete remote technical support to diagnose the issue and determine whether it can be resolved through remote guidance or spare parts delivery;
  2. If onsite repair is confirmed to be necessary, we will use commercially reasonable efforts to coordinate an authorized service provider in your area. If successfully arranged, any additional mileage charges and other payable costs shall be confirmed and paid in advance before scheduling the service;
  3. If, despite commercially reasonable efforts, onsite repair services cannot be arranged, we will provide one of the following alternative solutions free of charge (at your option):
(i) expedited shipment of original spare parts together with official repair instructional videos (videos only, without real-time remote guidance); or
(ii) prepayment of labor costs for a locally selected licensed repair provider (subject to prior submission of technician qualifications and repair quotation). The subsidy shall be capped at USD 350 per incident and subject to our prior approval. Any amount exceeding the cap shall be borne by you;
  1. If option (i) is selected, your free onsite repair entitlement will not be deducted; if option (ii) is selected, it shall be deducted as equivalent to a standard onsite repair service.

VI. Coverage Scope and Exclusions

6.1 Covered Services

This Care Plan covers exclusively the explicitly specified equipment failures and service entitlements set forth below. Any demand or request beyond this specified scope falls outside Speediance's fulfillment obligations:
  1. Core Hardware Extended Coverage: Free repair and original spare part replacement for functional failures of the Device's core components caused by material or workmanship defects within the Total Coverage Period;
  2. On-Site Maintenance Services: Complimentary authorized on-site repair services within the specified term and visit quotas, covering eligible equipment failure scenarios;
  3. Cable Replacement Rights: Complimentary replacement entitlements for original resistance cables within the specified term and usage limits;
  4. Digital & Support Privileges: Full-feature Wellness+ membership access and VIP Express Support Services for the designated duration;
  5. One-Time Machine Replacement: One-time free full machine replacement service including round-trip standard shipping fees, subject to qualifying terms and conditions.

6.2 Exclusions

Speediance reserves the right to refuse service, deny benefit claims, and assume no refund or liability under any of the following circumstances:

6.21 Improper Use or Operation (Damage/Loss Caused by Subjective User Error)

  1. Damage not caused by manufacturing defects, including improper installation, use, or disassembly, or failure to follow official instructions or manuals;
  2. Continued use after component failure causing further damage, including secondary or consequential damage (not covered);
  3. Unauthorized circuit modification, improper charger or power supply usage, or operation under low/defective battery conditions;
  4. Indirect damage caused by improper installation or disassembly, including damage to personal property, walls, or flooring.

6.22 Unauthorized Modifications and Third Party Interference (Damage Caused by Private Modifications or Third-Party Accessories)

  1. Unauthorized modification, disassembly, or repair, or use of nonofficial technical support resulting in damage;
  2. Intentional damage or unauthorized alteration (including tampering with operational data);
  3. Use of unauthorized thirdparty components causing damage due to compatibility or reliability issues;
  4. Failure or damage of any thirdparty products, including those integrated into Speediance products at your request.

6.23 Environmental and Force Majeure Factors (Damage caused by External Environmental Conditions, Sudden Environmental Changes, or Force Majeure Events)

  1. Exposure to extreme environments such as high temperatures or corrosive conditions;
  2. Operation in environments with electromagnetic interference or interference from other wireless devices;
  3. Damage caused by force majeure events such as fire, flood, earthquake, or power failures;
  4. Improper storage, transportation, or handling, including fire, water damage, or lightning.

6.24 Normal Wear and Other Conditions (Excluding Damage caused by Natural Wear and Tear, Improper Usage Scenarios, and Non-Hardware-Related Issues)

  1. Normal wear and tear or cosmetic damage not affecting functionality, including scratches, dents, rust, discoloration, or performance degradation not caused by manufacturing defects;
  2. Use of noncommercial products in commercial settings (e.g., gyms, hotels, or private training studios);
  3. Products or components with altered or removed identification labels are not eligible for warranty service;
  4. Any preinstalled or subsequently installed software is not covered under this warranty.

VII. Cancellation and Refund Policy

This Policy complies with the rules of the U.S. Federal Trade Commission (FTC) and applicable state laws governing extended warranty services. All approved refunds will be returned to the original payment method within fifteen (15) business days.

7.1 Valuation of Bundled Product Components

Speediance Care is a bundled product that includes multiple benefits. For the purpose of refund calculations, the Manufacturer’s Suggested Retail Price (MSRP) of each component is as follows (where state law provides otherwise, such law shall prevail):
Original Resistance Cables (tangible product): $59.99
Wellness+ Membership (digital benefit): $24.99
VIP Priority Support (service benefit): valued at $50 annually
Official Onsite Repair Service (service benefit): fair market value of $350 per service

7.2 Full Refund Within 60-Day Cooling-Off Period

Within sixty (60) days from the date of purchase, provided that no Care service benefits have been activated or utilized (including but not limited to: no redemption of Resistance Cables, no activation of Wellness+ membership, and no repair requests or VIP consultations), you may apply for a 100% full refund without any deductions.

7.3 ProRated Refund After Benefit Activation or After 60 Days

If any benefits have been activated or used, or if a refund is requested after sixty (60) days from purchase, the refund amount will be calculated as follows:

Refund Amount = [(Original Care Purchase Price − Value of Consumed Benefits) × (Remaining Coverage Days ÷ Total Coverage Days)] − Administrative Fee ($25)
Explanation of Consumed Benefits:
Physical Goods: Once the original resistance band enters the shipping process, a deduction of USD 59.99 shall apply. Due to hygiene and safety standards, returned Resistance Cables cannot be accepted to offset this deduction.
Digital Services: Once a Wellness+ membership code is redeemed or activated, a deduction of USD 24.99 shall apply.
Fulfilled Service Costs: Includes completed on-site repair visits ($350 per visit) and associated spare parts costs, mail-in repair shipping and freight fees, full machine replacement expenses, and other incurred fulfillment costs.
State Law Exceptions: In jurisdictions where the deduction of fulfillment costs is prohibited by law (including, without limitation, California, New York, Washington, and Florida), such fulfillment costs (USD 350 per visit) shall not be deducted when calculating the refund. However, the value of delivered physical or digital goods and the administrative fee shall still be deducted in accordance with applicable law.

7.4 Administrative Fee

Except in cases of full refunds, all refund requests are subject to an administrative processing fee of $25 (or 10% of the refund amount, whichever is lower). If applicable state law imposes a lower limit, such law shall prevail.

7.5 Coordinated Refunds with Hardware Returns

  1. If you return the device for a full refund within the manufacturer’s coolingoff period, the Care service may also be fully refunded without deductions.
  2. If the device is returned due to quality issues, the Care service refund will be calculated on a prorata basis according to the remaining coverage period.
  3. Upon completion of the device return, all associated Care service benefits will be immediately and permanently terminated.

7.6 Loss Cap

If the calculated refund amount is negative (i.e., the value of consumed benefits exceeds the purchase price), the refund amount shall be deemed $0. No additional payment will be sought from you beyond the original amount paid.

7.7 Cancellation Initiated by the Company

  1. We may terminate this Plan by providing thirty (30) days’ prior written notice to your registered email address under the following circumstances:
  • Regulatory Requirement: The relevant regulatory authority requires the program to be terminated.
  • Compliance Changes: Any change in the program operator’s compliance status renders the existing agreement unenforceable.
  • Refund Settlement: In such cases, refunds shall be calculated pro-rata based on the remaining coverage period, and the value of delivered physical or digital benefits (resistance band USD 59.99; membership USD 24.99) and any incurred fulfillment costs shall be deducted, except in jurisdictions where deduction of fulfillment costs is prohibited by law.
  1. We reserve the right to immediately terminate this Plan without refund and require payment of all service costs incurred if:
  • You fail to pay any due amounts under this Plan within fifteen (15) days after written notice; or
  • You materially breach these Terms, including but not limited to intentional damage, unauthorized modification, or misuse of the device that increases service risk.

7.8 Termination of Benefits Upon Refund

Upon completion of any refund, all Care service benefits associated with the device will be immediately and permanently terminated. You will no longer be entitled to claim any unused benefits or submit repair requests under this Plan. If the device remains within the original manufacturer warranty period, you may continue to seek service through the manufacturer’s warranty channels. Care benefits are nontransferable, nonredeemable for cash, and nonreinstatable.

VIII. Responsibilities and Obligations of Users

This section is fully consistent with the Speediance Limited Manufacturer Warranty Policy:
  1. Duty to Review Terms: You shall carefully read all the contents of these Terms to fully understand the scope of coverage, limitations, exclusions, and your obligations under this Plan.
  2. Maintenance Obligation: You shall use, maintain, and service the equipment in accordance with the requirements set forth in the original manufacturer’s user manual to ensure that the equipment remains in normal operating condition.
  3. Documentation Retention: You shall properly retain all relevant documents, including but not limited to the order confirmation for this Plan, the original purchase invoice for the equipment, and maintenance service records. These documents must be provided as requested when applying for service.
  4. Data Backup Responsibility: Prior to submitting the equipment for repair, you are responsible for backing up all personal data stored within the device. We shall not be held liable for any loss or disclosure of data occurring during the repair process.
  5. Packaging Responsibility: If you are required to return the equipment for repair, please package the device according to the official standard packaging guidelines. You shall bear full liability for any transit damage resulting from improper packaging.
  6. Inspection Obligation upon Receipt: Upon receipt of the repaired or replaced equipment, you shall inspect the condition of the equipment within seventy-two (72) hours. Failure to provide feedback within this period shall be deemed as your acknowledgment that the equipment is in good condition.
  7. Product Storage Policy: If the product cannot be delivered due to reasons such as an incorrect delivery address provided by you or failure to sign for receipt, we will provide free storage for thirty (30) days. Thereafter, a storage fee of $30 per day shall be charged. If the product remains undelivered after ninety (90) days, we reserve the right to dispose of the product in accordance with local laws and after issuing a final written notice. The proceeds from such disposal shall first be used to offset outstanding fees, and any remaining balance shall be handled in accordance with applicable laws.
  8. Obligation for Compliant Use: If you use the product in violation of official instructions or the product user manual, or use the product for any illegal purpose, we reserve the right to terminate the Care Service and the original manufacturer’s limited warranty service.

IX. LIMITATION OF LIABILITY

  1. Disclaimer of Warranties: To the maximum extent permitted by applicable law, except as expressly set forth in these Terms and the Speediance Limited Manufacturer’s Warranty Policy, Speediance provides this Care Plan "as is" and disclaims all other warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranties arising from course of dealing or usage of trade.
  2. Coverage Cap and Limitation of Direct Monetary Liability:
  • Hardware Service Coverage Cap: The maximum cumulative value of hardware repairs and replacement parts provided under this Plan shall not exceed the original purchase price of the covered Equipment.
  • Limitation of Direct Monetary Liability: Except as otherwise required by mandatory state laws, Speediance's total aggregate monetary liability for any direct damages, contractual breaches, or legal claims arising out of or in connection with this Care Plan shall be strictly limited to the total purchase price actually paid by the user for this Care Plan.
  1. Binding Terms & Unauthorized Commitments: Speediance is bound strictly by the explicit written terms set forth herein. No oral statements, advertisements, or third-party sales representations exceeding these Terms shall be binding unless officially confirmed in writing by an authorized representative of Speediance.
  2. Exclusion of Consequential and Indirect Damages: To the maximum extent permitted by applicable law, Speediance shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to equipment downtime, fitness schedule disruption, loss of income or profits, loss of use, or damage to reputation.
  3. Personal Injury and Property Damage: Speediance assumes liability for direct personal injury (including death) or tangible property damage strictly caused by Speediance's gross negligence or willful misconduct, pursuant to applicable laws. Speediance assumes no liability for losses resulting from user negligence, misuse, failure to follow manual instructions, or third-party fault.
  4. Subrogation: If Equipment damage is caused by a third party and Speediance provides repair or replacement services at no cost to you, you agree to assign to Speediance all rights of recovery against that third party to the extent of the repair/replacement costs incurred, and to provide reasonable assistance as requested.

X. State Law Compliance Statement

These Terms shall be governed by U.S. federal law and the laws of the state where the device was originally purchased. If any provision of these Terms conflicts with mandatory consumer protection laws or extended warranty regulations of the state of purchase, such conflicting provision shall be governed by the applicable mandatory state law, while the remaining provisions shall remain in full force and effect.
Certain states do not permit limitations on implied warranties, limitations on recovery of consequential damages, or restrictions on refunds following substantial claims. To the extent any such limitation is prohibited by applicable law, such limitation shall not apply to users residing in such states.

XI. Dispute Resolution

The dispute resolution provisions of these Terms shall remain fully consistent with those governing Speediance device sales and the Manufacturer’s Warranty Policy:
  1. Any dispute, claim, or controversy arising out of or in connection with this Care service shall first be resolved through amicable negotiation between the parties;
  2. If negotiation fails, the dispute shall be submitted to a court of competent jurisdiction in the state where the device was originally purchased, and shall be governed by the substantive laws of that state (excluding conflict of laws principles);
  3. For disputes involving amounts less than USD $10,000, you may choose to file a claim directly in a small claims court within your jurisdiction without prior negotiation, and we will fully cooperate with the procedures of such court.

XII. General Legal Provisions

  1. Entire Agreement: These Terms, together with the Speediance Manufacturer’s Limited Warranty Policy and your order confirmation, constitute the entire agreement between you and us regarding this Care service, and supersede all prior oral or written representations and agreements. No agent is authorized to modify or waive any provision of these Terms. Any additional representations not confirmed in writing and officially stamped by us shall have no legal effect.
  2. Severability: If any provision of these Terms is held by a competent authority to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the validity, legality, and enforceability of the remaining provisions shall not be affected.
  3. Privacy Protection: We strictly comply with the California Consumer Privacy Act (CCPA/CPRA) and other applicable U.S. federal and state privacy laws. We only collect and use personal information necessary to perform the Care service. You may request access to, correction of, or deletion of your personal information at any time through official customer service channels, and we will respond within the legally required timeframe.
  4. Amendment Disclaimer:We reserve the right to amend these Terms in accordance with changes in laws, regulations, or service resources. Any amendments shall apply only to newly purchased Care services after the effective date of such amendments and shall not affect services already purchased and in effect. We will not unilaterally reduce any vested user rights through such amendments.
  5. Assignment of Contract: We may assign all or part of our rights and obligations under this Plan at any time by providing at least thirty (30) days’ prior written notice to your registered email address. We will ensure that the assignee has the necessary qualifications and capabilities to perform all obligations under this Plan. You shall have the right, within fifteen (15) days of receiving such notice, to raise reasonable objections to the assignee and terminate this Plan by written notice, and receive a refund in accordance with Section 7.3 (Pro-Rated Refund After Benefit Activation or After 60 Days). Upon assignment, the new obligor shall fully assume all obligations under these Terms, and your rights and benefits under this Plan shall remain unaffected. You may not assign any of your rights or obligations under this Plan. This Plan is non-transferable.
  6. Force Majeure: We shall not be liable for any failure or delay in performance due to force majeure events, including but not limited to earthquakes, fires, floods, wars, or government actions. We will make commercially reasonable efforts to notify you in advance and resume performance as soon as practicable after the force majeure event ends.
